Terms of Service

Please read these terms of service carefully before using Harbour Escape Rooms services.
1. Acceptance of Terms
By booking, participating in, or using any services provided by Harbour Escape Rooms ("we," "our," or "us"), you ("you" or "your") agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Harbour Escape Rooms. If you do not agree to these terms, please do not use our services or facilities.
We reserve the right to modify these terms at any time without prior notice. Your continued use of our services after any such changes constitutes your acceptance of the new terms. It is your responsibility to review these terms periodically for updates.
2. Service Description
Harbour Escape Rooms provides interactive entertainment experiences through themed escape rooms located in Canada. Our services include but are not limited to:
- Escape room experiences with various themes and difficulty levels
- Team building activities for corporate groups
- Private event hosting and party bookings
- Educational programs for schools and organizations
- Special themed events and seasonal experiences
All services are subject to availability and may be modified or discontinued at our discretion. We strive to provide accurate descriptions of our experiences, but actual rooms may vary slightly from promotional materials.
2.1 Age Requirements
Children under 16 must be accompanied by an adult at all times. Participants under 18 require parental consent to participate in our escape room experiences. Some rooms may have specific age restrictions due to content or difficulty level.
3. Booking and Reservations
All bookings must be made through our official website, phone, or in-person at our facility. We require advance booking for all experiences, and walk-ins are subject to availability. Payment is required at the time of booking to secure your reservation.
3.1 Cancellation Policy
Cancellations made more than 24 hours before your scheduled experience will receive a full refund. Cancellations made within 24 hours of your booking time will be charged a 50% cancellation fee. No-shows will be charged the full amount with no refund available.
3.2 Rescheduling
Reschedules are allowed up to 4 hours before your scheduled experience, subject to availability. Reschedules requested with less than 4 hours notice may be subject to additional fees.
3.3 Group Size Requirements
Each escape room has minimum and maximum participant requirements. If your group size falls below the minimum on the day of your experience, you may be charged for the minimum required participants or be asked to combine with another group.
4. Health and Safety
The safety of our participants is our top priority. By participating in our escape room experiences, you acknowledge that:
- You are physically and mentally capable of participating in the activity
- You do not have any medical conditions that would prevent safe participation
- You will follow all safety instructions provided by our staff
- You will immediately report any injuries or concerns to our staff
4.1 Medical Conditions
Participants with heart conditions, claustrophobia, pregnancy, back problems, or other medical conditions that may be affected by physical activity, enclosed spaces, loud noises, or flashing lights should consult with their physician before participating and must inform our staff of any such conditions.
4.2 Safety Equipment
Safety equipment and emergency exits are clearly marked in all rooms. Participants must not interfere with safety equipment or attempt to circumvent safety measures. Emergency stops are available in all rooms and will immediately halt the experience.
5. Code of Conduct
All participants must conduct themselves in a respectful and appropriate manner. The following behaviors are strictly prohibited:
- Inappropriate language, harassment, or discriminatory behavior
- Intoxication or being under the influence of drugs or alcohol
- Damaging or attempting to damage props, equipment, or facilities
- Bringing unauthorized items into escape rooms
- Photography or recording without permission
- Sharing puzzle solutions or hints with other groups
We reserve the right to remove participants who violate our code of conduct without refund. Participants may be held liable for any damage to our property.
6. Privacy and Personal Information
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
We may use photos or videos taken during your experience for promotional purposes unless you specifically opt out. Please inform our staff if you do not wish to be photographed or recorded.
7. Limitation of Liability
To the fullest extent permitted by law, Harbour Escape Rooms, its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from your use of our services shall not exceed the amount you paid for the specific service giving rise to the claim.
7.1 Assumption of Risk
By participating in our escape room experiences, you acknowledge that there are inherent risks associated with physical activity and interactive entertainment. You voluntarily assume all risks of injury or damage that may result from your participation.
8. Intellectual Property
All content, including but not limited to puzzles, storylines, characters, music, sound effects, and room designs, is the exclusive property of Harbour Escape Rooms and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works based on our content without express written permission. This includes sharing puzzle solutions, room layouts, or story elements on social media or other platforms.
9. Force Majeure
We shall not be liable for any failure or delay in performance of our services due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, labor disputes, or technical failures.
In such cases, we will make reasonable efforts to reschedule your experience or provide appropriate compensation.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of Canada and the province in which our facility is located. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in that province.
11. Severability
If any provision of these terms is found to be unenforceable or invalid, such provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms shall remain in full force and effect.
